Privacy statement

This is a translation of the Dutch privacy statement. In the event of any discrepancy between the English and the Dutch text, the Dutch text prevails.
Van Leeuwen de Witt B.V. (hereinafter: VLDW) processes personal data of candidates, clients and visitors to this website. In this statement we explain which data we process, for which purposes and on which legal bases we do so, how long we retain data, with whom we share data and which rights data subjects have.

2. Which data we process
From candidates
- Name, contact details and place of residence.
- Curriculum vitae, education and work experience.
- Public data from your profile on LinkedIn or comparable professional platforms.
- Notes from conversations we have with you.
- Availability, role preferences and preferences regarding employment conditions.
- Data from assessments, reference checks or other forms of screening, only insofar as these are relevant to the role, you have been informed in advance about their purpose and nature and a valid legal basis exists for them.
From clients
- Name and contact details of contact persons.
- Data required to carry out the assignment, such as role profiles and information about the team and the organisation.
- Administrative data required for invoicing and contract management.
From website visitors
This website uses no tracking cookies and no analytics, insofar as the website is in fact set up in accordance with this statement. When you contact us through the website, we process the data you provide to us yourself.
3. What we use your data for
- To approach candidates for roles that in our judgement match their professional profile.
- To introduce candidates to a client, after their consent.
- To support candidates during an application procedure and, where relevant, afterwards.
- To carry out assignments for clients.
- To stay in touch about suitable roles in the future, where a valid legal basis exists for this.
- To manage agreements, to invoice and to keep our administration.
4. On which legal basis we do so
Consent: among other things where consent is the appropriate legal basis for retaining candidate data for future vacancies or for sharing data with a client.
Performance of an agreement: for the services provided to clients and insofar as processing is necessary in connection with a current assignment or procedure.
Legitimate interest: among other things to approach professionals on the basis of publicly available professional profile data for a specific, suitable role. In doing so we weigh our interest against the interests and rights of the data subject. An objection can be made against this processing.
Legal obligation: among other things for our financial and tax administration.
5. How long we retain your data
Candidate data processed solely for a specific procedure is in principle deleted no later than four weeks after that procedure has ended, unless further retention is necessary or you have given consent to retain your data for longer.
Where you give consent to be approached for future roles, we retain your data for a maximum of one year after the procedure has ended. If we wish to continue retaining your data after that, we ask for consent again where necessary.
If you have been placed through VLDW, we retain data belonging to the assignment and the placement for as long as this is necessary for carrying it out, supporting it and settling it, and insofar as a statutory retention obligation or legitimate interest requires further retention.
Invoices, contracts and other data subject to a statutory tax or administrative retention obligation are retained for the applicable statutory period.
We assess periodically whether personal data is still necessary and delete or anonymise data once the applicable retention period has expired.
6. With whom we share your data
Clients. We introduce a candidate to a client only after the candidate has consented to this, and in doing so we share only data that is relevant to the procedure concerned. Once the client receives the data, the client is in principle independently responsible for the further processing.
Service providers. For our business operations we may engage service providers, including:
- Hostnet B.V.: email and domain management.
- Google Ireland Ltd.: storage and collaboration through Google services.
- LinkedIn Ireland Unlimited Company: recruitment and professional contact with candidates.
- Netlify Inc.: hosting of the website.
- Anthropic PBC: AI support in work processes, insofar as this is used.
Where personal data is processed outside the European Economic Area, we ensure an appropriate transfer basis, such as an adequacy decision or the standard contractual clauses of the European Commission, insofar as legally required.
We do not sell personal data.
7. Artificial intelligence
VLDW may use AI tools to support its work, for example in analysing professional information, drafting texts and administrative processes. VLDW does not allow an AI system to decide independently whether a candidate is approached, introduced or selected. The relevant professional judgement remains with VLDW and/or the client.
8. Your rights
Insofar as the GDPR grants you that right, you can request:
- access to your personal data;
- rectification of incorrect data;
- erasure of data;
- restriction of processing;
- objection to processing;
- portability of data;
- withdrawal of consent given earlier.

We respond within the statutory period. You also have the right to lodge a complaint with the Dutch Data Protection Authority.
9. Security
VLDW takes appropriate technical and organisational measures to protect personal data against loss, unauthorised access, alteration or unlawful processing. Access to personal data is limited to people who need it for their work. Security measures are aligned with the nature and risks of the processing.
10. Changes
VLDW may amend this privacy statement when legislation, systems or working methods change. The current version is published on the website, stating the date of the most recent change.
